In Venezuela Holdings and others v. the Bolivarian Republic of Venezuela (ICSID Case No. ARB/07/27), an ICSID tribunal has considered issues of fair and equitable treatment and expropriation, in particular whether Venezuela’s expropriation of the claimant’s assets was lawful and the amount of compensation to be awarded.
