In Newham LBC v Osmar (unreported), a local authority appealed a magistrates' court's refusal to recall a witness in the respondent's trial to give live evidence on matters that had only arisen during the course of the trial. The appeal was allowed as the decision could potentially lead to a substantial injustice.
