"Substantially enclosed" under regulation 2 does not produce a 50% rule (High Court)

Newham Borough Council appealed an acquittal of the defendant on a charge of failing to cause a person to stop smoking in smoke-free premises under section 8 of the Health Act 2006. Newham appealed by case stated on grounds that the premises were "substantially enclosed" for the purposes of section 2 of the Act by reference to regulation 2 of the Smoke-free (Premises and Enforcement) Regulations 2006.
