Indirect sex discrimination

The Employment Appeal Tribunal (EAT) has held that where a claim of indirect sex discrimination is based on the claimant satisfying some but not all specified criteria for promotion, the pool of persons to be taken into account for the purposes of deciding whether there has been disparate impact between men and women, are those persons who satisfy the same criteria as the claimant.
