Commercial Court upholds the compensatory principle in the assessment of damages for anticipatory breach

In Flame SA v Glory Wealth Shipping PTE Ltd [2013] EWHC 3153 (Comm) (22 October 2013), the court considered whether, when assessing damages for anticipatory breach of contract, the court should take into account the innocent party's inability to perform its obligations under the contract at the time of the other party's repudiatory breach, so as to reduce the level of damages to a nominal amount.
