The Practice Direction (PD) making document associated with the 79th CPR update has been published. There are important changes to a number of PDs, as well as a new PD on pre-action conduct (PDPAC) and a PD on electronic working (PD 51J). The majority of the amendments and the introduction of the new PDPAC and PD 2B (Allocation of cases to levels of judiciary) came into force on 6 April 2015. The implementation of PD 51J is expected to take effect on 27 April 2015.
A number of important changes to practice directions (PDs) have been announced as part of the 79th update to the CPR. The Practice Direction making document introduces the following new PDs:
PD 51J (Electronic Working Pilot Scheme). This sets out the procedure for filing documents electronically under the electronic working pilot scheme, which will operate in the Technology and Construction Court in the Rolls Building. It is expected to apply to existing claims and claims started on or after 27 April 2015. (For further information, see Legal update, Guidance on the electronic working TCC pilot practice direction.)
PD 51K (The County Court legal advisers pilot). From 1 October 2015 to 30 September 2016, the County Court legal advisers' pilot scheme will operate in relation to claims started at the County Court Business Centre and the County Court Money Claims Centre.
A number of amendments have also been made to existing PDs, namely:
PD 6B (Service out of the jurisdiction), in relation to claims about trusts.
PD 52C (Appeals to the Court of Appeal), in relation to the respondent's actions when served with the appellant's notice.
PD on Solicitors' negligence in right to buy cases.
