Defendants cannot use frozen funds to pay for legal expenses (Commercial Court)

In Tidewater Marine International Inc v Phoenixtide Offshore Nigeria Ltd and others [2015] EWHC 2748 (Comm), the Commercial Court considered whether to order the claimant to make a joint request with the defendants to vary a Swiss freezing order so that the defendants could draw funds from a frozen swiss bank account and pay for legal representation.
