In Jockey Club Racecourse Ltd v Willmott Dixon Construction Ltd [2016] EWHC 167 (TCC), the court considered the appropriate costs order where the defendant had failed to accept the claimant’s Part 36 offer to settle the issue of liability (for losses arising out of defects in the roof of a new grandstand building) if the defendant accepted liability to pay 95% of its damages claim.
