Senior Costs Judge provides guidance on proportionality test (SCCO)

In BNM v MGN Ltd [2016] EWHC B13 (Costs), the Senior Costs Judge set out his reasons for halving the sums which he had allowed as reasonable on the line by line assessment, on the basis that they were disproportionate. He also considered whether the new test of proportionality applied to additional liabilities and, if so, whether it should be applied to additional liabilities separately or on a global basis.
Permission has been granted to appeal to the Court of Appeal and judgment was handed down on 7 November 2017. For more information, see Legal update: case report, Court of Appeal holds that old proportionality test applies to pre-commencement and recoverable additional liabilities.
