Intra-EU investment disputes: tracker

A tracker outlining developments on issues relating to investment disputes that arise under intra-EU bilateral investment treaties (intra-EU BITs) or intra-EU disputes under multilateral investment treaties (MITs), such as the Energy Charter Treaty (ECT). These disputes often result in jurisdictional objections based on the compatibility of the investor-state dispute settlement (ISDS) clauses in investment agreements with EU law. The tracker, which also considers the draft regulation on BITs between member states and third countries, monitors the positions taken on the compatibility of intra-EU investment disputes with EU law by the European Commission, the Court of Justice of the European Union, the European Parliament, arbitral tribunals and member states' courts.
