Court of Appeal clarifies scope of 10% increase in general damages

In Simmons v Castle [2012] EWCA Civ 1288, the Court of Appeal considered whether the 10% increase in general damages recommended by Jackson LJ should apply in contract claims as well as tort claims. It also considered whether it should apply to claimants who enter into a conditional fee agreement (CFA) before 1 April 2013, and the types of damages to which the increase will apply.
