Court of Appeal rules on suitability of assessor in Equality Act 2010 discrimination claim

by Practical Law Commercial with thanks to Claire Darwin of Matrix Chambers
The Court of Appeal has ruled that an assessor assisting a judge in a same sex sexual orientation discrimination claim against the police in relation to the provision of services did not require specific experience and expertise in relation to same sex sexual orientation discrimination in society generally. It was sufficient that she had experience of other forms of discrimination in an employment context. (David Cary v Commissioner of Police for the Metropolis and another [2014] EWCA Civ 987)
