In Morgan v Zelinski (unreported, 10 September 2015), Fraser J in the Technology and Construction Court (TCC) enforced an adjudicator's decision issued following a dispute arising out of the JCT's Building Contract for a Home Owner/Occupier who has not appointed a Consultant to oversee work (JCT HO/B 2009).
