A reminder that without prejudice privilege cannot be waived unilaterally (Court of Appeal)

In Gresham Pension Trustees v Cammack [2016] EWCA Civ 655, the Court of Appeal considered an appeal against a costs order made following settlement of proceedings save as to costs. In particular, the court considered whether the judge's exercise of his costs discretion was flawed due to his reliance on an attendance note purporting to record discussions which the appellant contended were without prejudice.
