Overriding interests and the Land Registration Act 2002

Overriding interests are a statutory creation, initially under the Land Registration Act 1925, which was replaced by the Land Registration Act 2002, supported by the Land Registration Rules 2003. Overriding interests are not protected on the land register but bind any person who acquires an interest in that land.

This Practice note explains the different categories of overriding interest under the Land Registration Act 1925 and the Land Registration Act 2002. It contains important action points for practitioners to take to protect those overriding interests that will be phased out with effect from 13 October 2013, and to safeguard interests on an acquisition of land subject to overriding interests.
