New Land Registry rules and forms come into effect on 10 November 2008

On 10 November 2008, new land registration rules (New Rules) that amend some of the current land registration rules and practice will come into force. These New Rules should make the land registration process more efficient and are the result of the Land Registry's extensive review of the current rules, and its consultation: "Review of Land Registration Rules 2003" that closed on 14 January 2008.

The New Rules are contained in the following statutory instruments:
  • The Land Registration (Amendment) Rules 2008. These amend the Land Registration Rules 2003 (LRR 2003) and the Land Registry application forms prescribed by the LRR 2003.
  • The Land Registration (Proper Office) (Amendment) Order 2008. This amends the Land Registration (Proper Office) Order 2007 (Proper Office Order 2007), so that the definition of "conveyancer" in paragraph 2(2) of the Proper Office Order 2007 includes barristers and certain registered European Lawyers.
  • The Commonhold (Land Registration) (Amendment) Rules 2008. These amend the Commonhold (Land Registration) Rules 2004. They introduce the use of "statements of truth" instead of statutory declarations.
