TUPE: Secretary of State not liable for basic award

The Employment Appeal Tribunal has held that where regulations 8(1) to (6) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) apply to a transfer of an insolvent employer’s business, the Secretary of State will not be liable for employment liabilities that arise after the transfer.
