An application for interim maintenance that includes an element towards legal fees, after the first case to deal with the point, A v A [2001] 1 FLR 377. A statutory regime introduced by the Legal Aid, Sentencing and Punishment of Offenders Act 2012 governs applications for interim provision for legal costs in proceedings for divorce, nullity ( www.practicallaw.com/8-538-0005) or judicial separation ( www.practicallaw.com/6-535-4408) . However, the case law following A v A still applies to applications under Schedule 1 to the Children Act 1989 and Part III of the Matrimonial and Family Proceedings Act 1984.
