In Mitchell v News Group Newspapers Ltd [2013] EWHC 2355 (QB), the court considered an application for relief from sanctions that had been imposed due to a failure to file a costs budget within the time specified in PD 51D (the defamation proceedings costs management scheme).
Note: Recognising the severe nature of the sanction, and due to the absence of specific authority on how strict the courts should be, Master McCloud granted permission to appeal of her own motion, under CPR 52.3(6)(b). The appeal was subsequently dismissed by the Court of Appeal (see Legal update, Mitchell appeal dismissed by Court of Appeal).
