Evidence of children's state of mind used to determine habitual residence (High Court)

In LC v RRL and others [2014] EWFC 8, the High Court applied the Supreme Court test in Re LC (Children) (No 2) [2014] UKSC 1 to establish the habitual residence of four siblings in international child abduction proceedings. Evidence of the children's state of mind was used to determine they had not acquired a new habitual residence in Spain when they relocated there with their mother, before being retained by their father following a visit to England.
