Scope of judicial immunity under Human Rights Act 1998 (High Court)

In Begraj and another v Secretary of State for Justice [2015] EWHC 250 (QB), the court considered a claim for damages against the Secretary of State on the basis of a failure to provide an impartial tribunal under Article 6 of the European Convention on Human Rights (ECHR). The claim followed a decision of the Employment Tribunal to recuse itself. The decision considers the scope of "judicial act" within the meaning of section 9 of the Human Rights Act 1998.
