Deprivation of liberty: duty on local authority to investigate least restrictive alternative (Court of Protection)

In P v Surrey County Council and Surrey Downs Clinical Commissioning Group [2015] EWCOP 54, the Court of Protection held that the local authority is required to ascertain the least restrictive alternative when granting a standard authorisation under the deprivation of liberty safeguards scheme. The case has recently become available on Bailli.
