In Elliston v Glencore Services (UK) Ltd [2016] EWCA Civ 407, the Court of Appeal considered an appeal against a decision that the respondent employee was entitled to a contractual termination payment. The appellant company submitted, amongst other things, that the judge had fundamentally misunderstood its pleaded case and made findings of fact that were unsupported by, or contrary to, the evidence.
