Although forms of predictive coding technology have been available for some time, its take-up, at least in English civil litigation, has been relatively modest. This cautious approach may have been because, until recently, there was no English authority on whether the use of predictive coding satisfied a disclosing party’s obligations under the Civil Procedure Rules.
