Amended Pre-Action Protocol for Construction and Engineering Disputes

A new Pre-Action Protocol for Construction and Engineering Disputes (the Protocol) takes effect from 6 April 2007.
As well as disputes under building contracts and professional appointments, the Protocol can affect, for example, a defects claim under an agreement for lease or a claim against a developer under a development agreement.
A court will impose costs sanctions on a party that does not comply with the Protocol.
