In International Transport Workers' Federation and Finnish Seamen's Union v Viking Line ABP and OU Viking Line Eesti (Viking) union action was taken to dissuade a Finnish ferry company from re-registering one of its Finnish-flagged ships in Estonia (in order to switch to cheaper Estonian crews).
The Advocate General considered that a national court would have to decide whether collective action conformed with national law whilst ensuring that cases of intra-Community relocation were not treated less favourably than cases of relocation within national borders.
