Pension scheme rules: don't brush mistakes under the carpet

PLC Magazine has published an article about the High Court decision in Smithson v Hamilton [2007] EWHC 2900 (Ch), written by Susan Garrett and Madeleine Cox from Addleshaw Goddard LLP. The authors warn that the decision suggests the courts are likely to adopt a strict approach with trustees and employers who wish to alter wording in scheme trust deeds and rules on the basis that it did not reflect their actual intentions.
