Practical Law UK Practice Note 9-502-4628 (Approx. 32 pages)

What is an investor for the purposes of investment treaty arbitration?

by Practical Law Arbitration, based on an original by Norton Rose Fulbright
To invoke the protections of an investment treaty, a claimant must establish that it is an investor, as defined by the relevant treaty. If it cannot do this, then the arbitral tribunal will lack jurisdiction ratione personae.
