People without capacity cared for in domestic settings were deprived of their liberty (Supreme Court)
On 19 March 2014, the Supreme Court delivered its judgment in P v Cheshire West and Chester Council [2014] UKSC 19. The court held that people without capacity who were being looked after by the local authorities in question had been deprived of their liberty, notwithstanding their apparent comfort in their placements.
