The High Court has considered whether an express choice of Guernsey jurisdiction in a novation deed meant that disputes relating to the underlying novated agreement should be considered in Guernsey, despite the underlying agreement providing for English jurisdiction. This case is a useful reminder for parties to give careful consideration to jurisdiction clauses across a suite of related agreements.
