CRC: Government publishes revised guidance on appeals

The Department of Energy and Climate Change (DECC) published revised guidance on appeals under the CRC Energy Efficiency Scheme, on 24 April 2015.

On 24 April 2015, the Department of Energy and Climate Change (DECC) published revised guidance for appeals under the CRC Energy Efficiency Scheme (CRC). The guidance explains how the appeals process has changed, following simplification of the CRC by the CRC Energy Efficiency Scheme Order 2013 (SI 2013/1119).
On 24 April 2015, the Department of Energy and Climate Change (DECC) published revised guidance for appeals under the CRC Energy Efficiency Scheme (CRC).
The guidance explains appeals relating to the:
  • First Phase (also known as the Introductory Phase or Phase 1, which ran from 1 April 2010 to 31 March 2014). Appeals in relation to the First Phase will be heard under the procedure set out in the CRC Energy Efficiency Scheme Order 2010 (SI 2010/768).
  • Initial Phase (also known as Phase 2 or Second Phase, which runs from 1 April 2014 to 31 March 2019) and subsequent phases, under the procedure set out in the CRC Energy Efficiency Scheme Order 2013 (SI 2013/1119) (CRC Order 2013).
The CRC Order 2013 simplified the CRC, including the appeals process, for the Initial Phase onwards. The main changes in the process are:
  • Appeals in England and Wales will be heard by the First-Tier Tribunal.
  • Calendar days, instead of working days, will be used to calculate dates in the appeal process.
  • The number of days in which to appeal will be determined by where the appeal is lodged in the UK. In England and Wales, there are 28 calendar days within which to make an appeal.
