On 1 June 2016, the Upper Tribunal (Administrative Appeals Chamber) held that the mere fact of physical possession of information does not satisfy the test as to whether information is "held" under the Environmental Information Regulations 2004 (SI 2004/3391) (Holland v Information Commissioner and another [2016] UKUT 260 (AAC)).
