In Re L (Habitual Residence: Domestic Abuse) [2016] EWHC 1844 (Fam), Cobb J applied the Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children of 19 October 1996 (1996 Hague Convention) to the question of a Ukrainian child's habitual residence and any transfer of proceedings using the same principles and case law applicable to Council Regulation (EC) 2201/2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility (Brussels II Revised).
