Is information forwarded by bidders in a public procurement exercise still confidential if the procurement rules are not followed?

We have entered into a contract that should have been let in accordance with the Public Procurement Regulations 2006 (PCR 2006), but unfortunately the proper procurement process was not followed. An information request has been made for documents relevant to the contract. Are these documents still covered by the confidentiality provisions in regulation 43 of the PCR 2006?
