What's on Practical Law?

Does the standstill period have to restart if more information is provided while it is running?

Anonymous (Public sector)

Q:
In a light touch regime, a contracting authority issued notice of intention to award letters with alcatel information as per regulation 86 of the Public Contracts Regulations 2015 (SI 2015/102) to bidders stating that it would observe a 10 day standstill period. During the 10 day standstill period, the contracting authority received correspondence from some of the bidders stating that the information provided failed to explain the reasons to include the characteristics and relative advantages of the successful tender as required by regulation 86 and that they considered the standstill letters wholly deficient and the current standstill period invalid.
If the contracting authority provides further information to these bidders, is it required to observe a further 10 day standstill period from the date on which the further information is sent (assuming it is sent electronically)? Also is there any case law on the point as to what if any period of time should be allowed to lapse by the contracting authority before entering into a contract in these circumstances where further information has been provided after the initial reasons provided under the notice of intention to award letters? The contracting authority is also extending the original standstill period in order to deal with this correspondence.
