Does a widow's pension, which the deceased nominated to his wife to receive upon his death, form part of the deceased's net estate for the purposes of a claim under the Inheritance (Provision for Family and Dependants) Act 1975?
Resource type: Ask
Published on 10-Jan-2017
Section 8 of the Inheritance Act 1975 provides for the inclusion of certain types of property to be treated as part of the "net estate".
Does this include the provision of a widow's pension which the deceased nominated his wife to receive upon his death?
If so, how does one calculate the value of such a benefit if the sum is paid monthly?
Any assistance is greatly appreciated.
