What's on Practical Law?
Practical Law may have moderated questions and answers before publication. No answer to a question is legal advice and no lawyer-client relationship is created between the person asking the question and the person answering it. Where appropriate, you should consult your own lawyer for legal advice. Practical Law's employees are not practising solicitors or barristers. The Ask scope and rules apply.

Is it possible to make a number of variations from the cash that represents the residuary estate?

Anonymous (Private practice)

Q:
Would the rule against making more than one variation of a will in respect of the same assets apply if the original residuary beneficiary of an estate, varied a will to include a cash legacy of part of his inheritance to a new beneficiary, but then, a couple of months later, decided to vary the will again to pass on a further cash legacy from the residuary estate to the same beneficiary? The residue is all cash.
