| 314 | Landowner prosecuted for obstructing Environment Agency On 16 July 2008, a magistrates' court fined a landowner, Mr Drake, £1,000 for obstructing Environment Agency (EA) officers who entered his land near Bodmin, Cornwall, to investigate why a river had become heavily discoloured (see EA news release).The EA officers entered the grounds of Mr Drake's country house in the dark wearing high visibility jackets and found that a lake near the river had been dredged. When Mr Drake returned, the officers explained that they were investigating a pollution incident. He demanded that they leave and said he would "be letting the dogs out". The District Judge said the incident was an "unpleasant, unnecessary and unedifying confrontation" and had Mr Drake co-operated with the officers it is unlikely that the case would have reached court.The EA prosecuted Mr Drake under section 110(1) of the Environment Act 1995, which makes it an offence for a person intentionally to obstruct an authorised person (including an EA officer) in performing his powers or duties. The aim is to prevent and mitigate the effects of major accidents involving dangerous substances, which can cause serious harm to people and/or the environment.At Chester Crown Court, Shell pleaded guilty to the offence, which occurred in 2003 at its Ellesmere Port site when corroded pipes released a highly flammable and toxic cloud of gases. The cloud eventually dispersed without injury or damage, but the incident was sufficiently significant that the COMAH competent authority for the UK, the Health and Safety Executive (HSE) (jointly with the Environment Agency in England and Wales), had to notify the European Commission.Shell's own internal report estimated that there could have been multiple fatalities and property damage over a significant area.The judge, in sentencing Shell, said that if Shell had not pleaded guilty a fine of £400,000 would have been appropriate. It is up to each member state to decide on the type and level of criminal penalty.In July 2005, the Council of Ministers adopted a Framework Decision requiring member states to impose criminal penalties for breaches of Directive 2005/35/EC and specifying the type and level of penalty that must be imposed. In October 2007, the European Court of Justice (ECJ) annulled the Council's Framework Decision, holding that it was up to the Commission to legislate on these matters and that neither the Council nor the Commission have the power to specify the type and level of criminal penalty (see Legal update, ECJ rules European Commission does not have power to set specific criminal penalties). The Council and Commission both agreed that pollution from ships is sufficiently serious to be treated as a criminal offence. According to reports in the press, the Crown Prosecution Service (CPS) is proposing to use paralegal cases workers to prosecute minor offences and cases where the defendant has pleaded "not guilty", so as to reduce its legal costs (see "Barely trained" paralegals will be forced to take CPS cases to trial, Times, 19 February 2008). The CPS is trying to agree reduced rates for prosecution barristers with the Bar Council. In the meantime though, clause 58 of the Criminal Justice and Immigration Bill could enable paralegal case workers to be used. However, a draft CPS report shows that over half of the CPS paralegals surveyed felt that they did not have the necessary skills. Currently, the proposals would only affect mainstream criminal cases brought by the CPS, such as theft and anti-social behaviour orders. Serious offences, including corporate manslaughter, would continue to be prosecuted by experienced lawyers (see Practice note, Corporate Manslaughter and Corporate Homicide Act). Most breaches of environmental law are prosecuted by the Environment Agency and local authorities (see Practice note, How are environmental offences prosecuted?). The EA used surveillance to show that large volumes of mixed waste were being delivered by local skip firms and building contractors. The company and Mr Craxford pleaded guilty to various offences under the Environmental Protection Act 1990 and the Pollution Prevention and Control Regulations 2000.The Exeter Crown Court convicted:The company, ordering it to pay a £60,000 fine and £18,855 costs.Mr Craxford, giving him a three-year conditional discharge and ordering him to pay £8,081 costs.The EA referred the case to the ARA to investigate to what extent the company and Mr Craxford had benefited from their illegal activities. | 333 | Merger of Health and Safety Commission and Executive On 30 January 2008, the Government laid the draft Legislative Reform (Health and Safety Executive) Order 2008 (the Order) before Parliament. The Health and Safety Commission (the HSC) and the Health and Safety Executive (the HSE) were created under the Health and Safety at Work etc Act 1974, as two separate public bodies. The HSC is responsible for setting health and safety policy. The HSE and local government are the enforcing authorities who work in support of the HSC. The two bodies were created to distance the HSC from the day-to-day operations of the HSE. This division is now thought to be at odds with thinking on corporate governance and accountability. As part of the Government's better regulation initiative, a consultation was carried out in 2007 on whether the HSC and HSE should merge. The draft Order merges the HSC and the HSE into one body to be called the Health and Safety Executive. The Order's Explanatory Document sets out the details of the new proposals, and how the transition will be managed in practice. The Code was published on 17 December 2007. The Order and Code were made under the Legislative and Regulatory Reform Act 2006 (the Act). The Code applies to a large number of bodies that exercise regulatory functions, including the Environment Agency (EA). | 338 | Fines based on turnover proposed for corporate manslaughter On 15 November 2007, the Sentencing Advisory Panel (the Panel) published a consultation document on sentencing for the new offence of corporate manslaughter. This offence was created by the Corporate Manslaughter and Corporate Homicide Act 2007, which is due to come into force on 6 April 2008. Courts will be able to impose: A publicity order. A remedial order. An unlimited fine. The Panel's view is that annual turnover is the most appropriate measure of an organisation's ability to pay a fine, and proposes that fines should be in the range of 2.5% to 10% of average annual turnover. In addition, significant aggravating factors or previous convictions may take the fine beyond the range above. Where the offender is a large organisation, this approach would result in much greater fines, more like those that can be given in competition cases. The largest fine imposed to date for a health and safety offence in the UK was when Transco was fined £15 million for breaches of regulations which led to four deaths in a gas explosion. This fine represented less than one per cent of its annual turnover. The new regime will apply to England and Wales only. Under the EP regime, operators of PPC or waste management activities can either apply for a standard or a bespoke EP permit. As a general rule, if an activity carries a relatively low environmental risk the operator should be able to apply for a standard permit, which will be quicker and cheaper than a bespoke permit. Standard permits will contain a set of standard conditions (also referred to as "general binding rules"), rather than site-specific conditions. The matter has been settled.The Law Society agreed to withdraw its claim, following a commitment from the Rules Committee that CPR 5.4C will be amended to apply only to statements of case filed in proceedings on or after 2 October 2006. A new rule should come into force on 18 December 2006.
