High Court refuses to grant summary judgment on Fujifilm's claim for Arrow declaration

The High Court has dismissed an application by the defendant owner of a divisional patent application for summary judgment on a claim for an Arrow declaration that, in effect, the claimant generic manufacturer would have a Gillette defence to a claim for infringement of that application once granted. (Fujifilm Kyowa Kirin Biologics Company Ltd v Abbvie Biotechnology Ltd and AbbVie Ltd [2016] EWHC 2204 (Pat), 8 September 2016.)
