Interim costs certificate refused where group litigation costs not reasonable and proportionate (Senior Courts Costs Office)

In Briggs and others v First Choice Holidays and Flights Ltd (unreported), 23 September 2016, (Senior Courts Costs Office), Master James determined a number of preliminary costs issues under the pre-April 2013 regime, including the impact of delay in pursuing detailed assessment under CPR 47.7 and 47.14, proportionality, and the appropriate level of success fees.
Note: On 8 February 2017, the High Court allowed an appeal of this decision (see Blog post, Recent decisions on the costs consequences of refusing to enter into ADR).
