Correct tests for "exceptional circumstances" and A1P1 proportionality applied in council application for consent to appropriate local allotments for redevelopment (High Court)

On 2 November 2016, the High Court held that the Secretary of State for Communities and Local Government had correctly applied the tests for "exceptional circumstances" and proportionality in accordance with A1P1 in its determination of a council's application for consent to appropriate a local allotment site (R (Andrew Moore) v Secretary of State for Communities and Local Government [2016] EWHC 2736 (Admin)).
