"Normal measure" of damages still applicable where claimant had benefited from market value increase of property in respect of which misrepresentations made (Court of Appeal)

In Quilter v Hodson Developments Ltd [2016] EWCA Civ 1125, the Court of Appeal considered the appropriate measure of damages where the claimant purchaser of a property, to whom misrepresentations had been made by the vendor development company, had benefited from an increase in the property's market value when she sold it two years later.
Note: On 30 March 2017, the Supreme Court refused permission to appeal this decision (see Hodson Developments Ltd v Quilter UKSC 2016/0224).
