In GW v Gloucestershire County Council [2016] UKUT 496, the Upper Tribunal considered whether guardianship under the Mental Health Act 1983 was necessary where the patient was also subject to a standard authorisation under the deprivation of liberty safeguards in the Mental Capacity Act 2005.
