Court of Appeal considers implied retainer and duty of care arguments in relation to witnesses

In James-Bowen and others v Commissioner for Police for the Metropolis [2016] EWCA Civ 1217, the Court of Appeal considered an appeal against an order striking out a claim by four police officers relating to the Commissioner's conduct in litigation in which the police officers were witnesses. The court considered whether the officers had an implied retainer with the Commissioner's legal representative and whether the Commissioner owed the officers a duty of care.
Note: On 30 March 2017, the Supreme Court granted permission to appeal this decision (see James-Bowen and others v Commissioner of Police for the Metropolis UKSC 2017/0003).
