Court of Appeal confirms that primary limitation periods apply to counterclaims

In Al-Rawas v Hassan Khan & Co (a firm) and another [2017] EWCA Civ 42, the Court of Appeal considered whether section 35 of the Limitation Act 1980 (in particular sections 35(1) and (3)) allows a counterclaim which would, otherwise, have been out of time when the claimant's claim was brought, to be advanced.
