What's on Practical Law?

Defendant subject to default judgment debarred from defending quantum claim and deprived of damages assessment process (Court of Appeal)

In Workman v Forrester and others [2017] EWCA Civ 73, the Court of Appeal considered a defendant's appeals against the court's refusal to set aside default judgment on liability, an unless order debarring him from defending quantum and directing entry of judgment for a specific sum, and a resultant judgment for £1.5 million in damages. The court also considered the defendant's appeal against the court's refusal to re-list a return date for a worldwide freezing order (WFO) obtained against him by the claimants.
Note: On 8 August 2017, the Supreme Court refused permission to appeal this decision (see Forrester and others (Respondents) v Workman (Appellant) UKSC 2017/0057.)
