No service provision change where new contractor takes over service for own commercial purposes

In CT Plus (Yorkshire) CIC v Black and others UKEAT/0035/16, the EAT considered whether an employment tribunal was correct to find there was no service provision change, for the purposes of regulation 3(1)(b)(ii) of TUPE 2006, on the basis that a new contractor was providing a service for its own commercial purposes and not on behalf of the council.
