In Reverend Canon Pemberton v Former Acting Bishop of Southwell and Nottingham UKEAT/0072/16, the EAT considered whether it was direct sexual orientation or marriage discrimination, or sexual orientation harassment, for a Bishop to refuse to grant the required qualification for a Priest to take up a position as hospital chaplain because he had entered into a same sex marriage.
